By using the Photo Booth, you agree that your access to these digital photo services is subject to the terms and conditions listed below.
The digital photo captured by the Photo Booth is the property of The University of Kansas and we license the digital photo to you for personal and non-commercial use purposes only. You may share or post the digital photo through text, email, and any social media network subject to compliance with these Terms of Use; we assume no liability or obligations to you or any other person regarding the use of the digital photo. By sending the digital photo to your email address or your mobile phone number, you consent to public display of the digital photo in the KU Welcome Center Photo Booth visual gallery and grant us a release for use of your image and likeness in the digital photo without compensation or other restriction when for this purpose. At any time, you may withdraw your consent to use of your image and likeness by contacting Marketing, Office of Public Affairs at publicaffairs@ku.edu.
Your privacy is very important to us. By using and accessing the Photo Booth, you agree that we may collect and use the information you provide during your access to provide the digital photo services to you. You agree that the information you provide to us will be true, accurate, current, complete, and belonging to you. Your personally identifiable data (i.e., email address and mobile phone number, if provided) will be stored and used only for sending the digital photo to you at your request. In order to provide the services to you we may collect information that is about you but individually does not identify you, such as IP address, date and time of visit, device information, operating system version, unique device identifiers, browser type, language, wireless language, and mobile network. We may also collect records and copies of your correspondence if you contact us.
Photo Booth services are not intended for minors under 13 years of age. If you are between the ages of 13 and 18, your use of the Photo Booth services shall require supervision by a parent or legal guardian who agrees to be bound by these Terms of Use. If you are under 13, do not use or provide any information, including your email address or mobile phone number to us. If we learn that we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.
You are responsible for any mobile and data charges that you may incur for using any of the Photo Booth services, including text messaging and data charges. If you are unsure what those charges may be, you should ask your service provider before using any of the Photo Booth Services.
We are providing access to the Photo Booth “AS-IS,” “As Available,” and “With All Faults” and without any express or implied warranties; we do not guarantee that the Photo Booth will always be secure, reliable, or error-free. We assume no liability whatsoever in connection with use of the digital photo services. You waive any legal or equitable rights or remedies you have or may have against us with respect to our performance of the services.
These Terms of Use are governed by the laws of the State of Kansas without regard to its conflict of laws provisions; venue for any cause of action will lie in Douglas County, Kansas. Each party waives any right it may have to a jury trial in any legal action, proceeding, or cause of action or counterclaim arising out of or relating to performance of these Terms of Use. If any provision of these Terms of Use is held to be lawful, void, or for any reason unenforceable, then that provision will be limited or eliminated from these Terms to the extent necessary and will not affect the validity and enforceability of the remaining provisions.
